Saudi employers often assume the recruitment process ends with Saudi approvals. It does not. India regulates the emigration of its workers under the Emigration Act, 1983, through the eMigrate system administered by the Ministry of External Affairs and the Protector of Emigrants. For most Indian workers going to Saudi Arabia, no clearance means no departure — and only a licensed agency can obtain it.
ECR and Non-ECR Passports
Indian passports are marked Emigration Check Required (ECR) or not (ECNR) based on the holder's education. Most trade and general workers hold ECR passports and need emigration clearance for eighteen notified countries including Saudi Arabia. Non-ECR holders (broadly, those with a matriculation-level qualification or above) do not need clearance but still travel under the same attested contract framework.
Foreign Employer Registration
Saudi employers recruiting through eMigrate are registered on the platform, either directly or through the recruiting agent, with their commercial registration details. Registration is straightforward and one-time; it allows demand letters and contracts to be lodged electronically.
The Documents That Must Be Attested
- Demand letter — stating professions, numbers, wages, contract period, accommodation, food, transport and medical provisions
- Power of attorney — authorising the Indian agency to recruit on the employer's behalf
- Employment contract — the model contract each worker signs
Each is attested by the Saudi Chamber of Commerce and the Saudi Ministry of Foreign Affairs, then by the Embassy of India in Riyadh (or Consulate General in Jeddah). The Embassy verifies that wages meet its minimum referral wages for each profession and that terms comply with Indian requirements.
Minimum Referral Wages
The Embassy of India publishes minimum wages by profession for Indian workers in Saudi Arabia. Demand letters below these figures are not attested, and the wage in the attested contract becomes the reference for wage-protection compliance in the Kingdom. Employers who set wages at the floor should expect higher turnover under the mobility reforms; the market band is usually above it.
Why Only a Licensed Agency
The Emigration Act permits recruitment for overseas employment only through Recruiting Agents licensed by the MEA. Taha Airwaves holds licence B-3260/DEL/COM/100/5/11259/2025. Unlicensed intermediaries cannot lodge demand letters, cannot obtain clearance and expose the employer to fraud and welfare complaints routed through the Embassy.
The Worker's Protection
eMigrate records the employer, agent and contract for every cleared worker. It underpins the Pravasi Bharatiya Bima Yojana insurance and the Embassy's welfare mechanisms — which is why Saudi project owners increasingly require evidence of eMigrate clearance in their supply-chain audits.
Timing
