The Ausländerbehörde — the local Foreigners Authority — is the office that converts a visa into a residence permit, runs the accelerated procedure, and renews permits each cycle. Employers who treat it as the worker's problem lose people to expired permits. Employers who engage with it directly get faster hires.
What the Authority Actually Decides
The German mission abroad issues the entry visa. The Ausländerbehörde issues the residence permit that follows it, extends it, approves changes of employer or role where required, and ultimately decides on permanent residence. It is the office your worker's legal status lives with for their entire time in Germany.
Which office is competent is determined by where the worker lives — not where your company is headquartered. For employers with sites across several districts, that means several authorities with somewhat different practices.
The §81a Accelerated Procedure
This is the part employers most often miss. Under §81a of the Residence Act, the employer — acting under power of attorney from the worker — applies to the Ausländerbehörde to run an accelerated skilled-worker procedure. The fee is €411 per case. The authority then coordinates recognition, Federal Employment Agency consent and the consular appointment against statutory deadlines.

Appointments Are the Real Constraint
In larger cities, appointment waiting times at the Foreigners Authority can run to weeks or months. The practical rules:
- Book the residence-permit appointment in the worker's first month, not when the visa is close to expiring
- A visa is typically valid six months; the permit application must be lodged inside that window
- Many authorities accept online pre-registration — use it the day the worker's address registration (Anmeldung) completes
The Employer's Own Duties
- Do not employ a worker whose permit has expired or whose permit does not cover the role — this is a criminal offence for the employer, not an administrative slip
- Track expiry dates in your HR system with alerts at 90 and 30 days
- Notify the authority of contract changes where the permit conditions require it
- Keep copies of passport, visa, permit, contract and BA approval for the statutory retention period
Renewals and Job Changes
Skilled-worker permits are typically issued for the contract duration up to four years, renewable. A change of employer within the first period generally needs the authority's approval; after the initial period, qualified workers move more freely. Blue Card holders notify a job change in the first twelve months and are free afterwards.

Build a relationship with the competent office, not just a file.
